These Terms of Service (“Terms”) govern your access to and use of hometourtv.com and submityourlisting.ca (collectively, the “Platforms”), operated by 2813434 Alberta Ltd. doing business as Olyveco (“Company,” “we,” “us,” “our”).
By accessing either Platform, creating an account, joining the Home Tour TV waitlist, or submitting a listing, you agree to be bound by these Terms. If you do not agree, do not use our Platforms.
These Terms constitute a legally binding agreement between you and 2813434 Alberta Ltd.

By submitting a listing, you represent and warrant that you meet all applicable requirements. We reserve the right to verify your identity and listing authority and to reject or remove submissions that do not comply.
Submission of a listing on submityourlisting.ca requires creation of an account. Your profile serves as the identity and branding source for all listing videos produced through Home Tour TV.
You are responsible for ensuring that the information in your profile is accurate, current, and — for MLS listings — compliant with your brokerage’s policies regarding agent marketing and branding. We are not responsible for errors in published videos that result from inaccurate profile information.
By submitting listing content through submityourlisting.ca, you represent and warrant that:

You are solely responsible for ensuring that the MLS number (or property address for private sales), listing price, and all other property details you submit are accurate and current. You acknowledge that:
By submitting a listing on submityourlisting.ca, you grant 2813434 Alberta Ltd. a non-exclusive, royalty-free, worldwide licence to:
This licence is granted for the duration of the active listing period and terminates automatically when the listing video is removed under Section 6.
You retain ownership of all content you submit. We do not claim ownership of your listing photos or profile information.
You may mark your listing as sold through your dashboard on submityourlisting.ca at any time. When you mark a listing as sold, we will remove the associated video from the Home Tour TV YouTube channel. Removal may not be instantaneous due to YouTube processing times.
You are responsible for marking your listing as sold in your dashboard when your property sells, goes conditionally sold, or is withdrawn from the market. If you are unable to access your dashboard, contact us at: hello@olyveco.com
We reserve the right to remove any listing video from the Home Tour TV YouTube channel at any time, for any reason, including but not limited to:
We will endeavour to notify you of removals not triggered by your own action, but are not obligated to do so.
During the launch period in Nova Scotia and Alberta, agents and property owners may submit listings at no cost. This free access is subject to:
The 15-photo and 20-photo templates may be available for a fee. Active Olyveco members in good standing may receive access to premium templates at no additional per-submission cost as a membership benefit.
We reserve the right to modify pricing at any time. Changes to pricing will not affect submissions already in progress.
All fees paid for premium template submissions are non-refundable except where required by applicable law. If a video is not produced due to a technical error on our part, we will offer a re-submission at no additional cost.
Access to the Olyveco professional community and the premium template membership benefit is governed by separate Olyveco membership terms available at olyveco.com. These Terms do not govern Olyveco membership.
All submissions are subject to automated guardrail checks including:
Submissions that fail guardrail checks will be rejected with an explanation.
Only one active submission is permitted per MLS listing number (or per property address and province for private sales) at any time. If a listing video is published and later removed, a new submission may be made for the same listing.
The Home Tour TV brand, logo, channel design, video template design, thumbnail design, website design, and all platform content created by us are owned by 2813434 Alberta Ltd. and are protected by Canadian and international intellectual property laws. You may not use our intellectual property without our prior written consent.
If you provide us with feedback, suggestions, or ideas about our platforms, you grant us the right to use that feedback without restriction or compensation to you.
THE PLATFORMS AND ALL SERVICES PROVIDED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT:
REFERENCES ON OUR MARKETING MATERIALS TO IMPROVED SEARCH VISIBILITY, AI SEARCH INCLUSION, OR INCREASED BUYER INQUIRIES REFLECT GENERAL INDUSTRY RESEARCH AND ARE NOT GUARANTEES OF RESULTS FOR ANY INDIVIDUAL LISTING.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 2813434 ALBERTA LTD. WILL NOT BE LIABLE FOR:
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to indemnify, defend, and hold harmless 2813434 Alberta Ltd., its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
Our service depends on and integrates with third-party platforms including YouTube (Google), Creatomate, ElevenLabs, Stripe, Supabase, and Vercel. We are not responsible for the availability, terms, or policies of those platforms. Changes to any third-party platform’s terms of service, API policies, or content policies may affect our ability to provide the Home Tour TV service. We will endeavour to notify you of material platform changes but cannot guarantee continuity of service.
Commercial electronic messages sent to you following your signup or submission are governed by CASL. By providing your email address on our platforms, you expressly consent to receiving commercial electronic messages from 2813434 Alberta Ltd. regarding Home Tour TV, submityourlisting.ca, and Olyveco products and services.
You may withdraw your consent at any time by clicking the unsubscribe link in any email we send you, or by contacting us at hello@olyveco.com. Withdrawal of consent does not affect transactional messages related to your active listings.
These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of our Platforms will be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration in Calgary, Alberta, administered under the Arbitration Act (Alberta), except that either party may seek injunctive or other equitable relief from a court of competent jurisdiction.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by email to registered users and by posting updated Terms on our Platforms. Your continued use of our Platforms after notice of changes constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 2813434 Alberta Ltd. with respect to your use of the Platforms and supersede all prior agreements and understandings.
